‘RHOA’ Alum Kandi Burruss’ Ex Todd Tucker Demands Primary Custody, Questions Prenupital Agreement (Exclusive)

Todd Tucker, the estranged husband of The Real Housewives of Atlanta alum Kandi Burruss, is seeking primary custody of their two young children amid their ongoing divorce proceedings, Us Weekly has exclusively learned.

According to court documents, Tucker filed his official response to Burruss’ divorce petition on Wednesday, November 26. In the filing, he stated that their children are currently living with him in Georgia and remain under his daily care, while Burruss, 49, is frequently traveling due to “out-of-state work obligations.”

The former couple shares two children: a son, Ace, born in 2016, and a daughter, Blaze, born in 2019. Tucker, 52, emphasized that Burruss’ professional commitments are expected to keep her away from home for at least the next several months, which he argues supports his request for primary physical custody.

In his filing, Tucker acknowledged that both parties have been attempting to resolve matters amicably. “The parties have been working cooperatively in an effort to resolve all issues,” the document states, adding that Tucker “remains committed to continuing those discussions in good faith.”

However, Tucker made it clear that if negotiations fail, he intends to formally pursue primary physical custody, joint legal custody, and final decision-making authority regarding the children. At the same time, he proposed that Burruss maintain “substantial time and meaningful access” to their kids.

Notably, Tucker’s legal team took care to praise Burruss’ parenting, describing her as a “loving and capable parent.” The filing emphasized that Tucker hopes ongoing discussions will ultimately lead to a full and mutual resolution, underscoring his desire to prioritize the children’s best interests.

Beyond custody, the divorce has also raised questions surrounding the couple’s prenuptial agreement. Tucker acknowledged that he signed a prenup prior to their wedding on April 4, 2014, but claimed he did so under pressure and without legal representation. His attorneys allege that Burruss’ legal counsel presented the final agreement to Tucker immediately before the wedding ceremony, despite prior communications with Tucker’s team regarding negotiations.

“These circumstances raise substantial questions concerning the enforceability of said document,” the filing asserted. Nevertheless, Tucker maintained that he is willing to work in good faith to resolve the matter privately and without unnecessary conflict.

Tucker’s counterclaim further calls for an equitable division of all marital assets, including both tangible and intangible property, and requests potential alimony should the prenuptial agreement be deemed unenforceable by the court.

Burruss initially filed for divorce on November 21, listing April 2014 as the date of marriage and July 15, 2025, as the date of separation. In her petition, she stated that the marriage is “irretrievably broken” with “no reasonable hope for reconciliation.”

The reality TV star proposed joint custody of their children, asserting that such an arrangement would best serve their needs. She also asked the court to enforce the prenuptial agreement signed prior to the marriage and requested an equitable division of marital debt in accordance with that agreement. Additionally, Burruss asked the court to determine the appropriate amount of child support.

As the case unfolds, custody, financial arrangements, and the validity of the prenuptial agreement are expected to remain central issues in the high-profile divorce.
